Find out how PSD2 affects your business - use our PSD2 Navigator

The information in these pages is aimed at:

• businesses that are currently regulated payment service providers
• businesses that operate under existing exclusions from the PSRs 2009[5]
• businesses that provide payment services that are coming within the scope of regulation for the first time – i.e. those providing account information services[6] (AIS) or payment initiation services[6] (PIS)

Please note the information in these pages is not aimed at the Post Office Limited, the Bank of England, the European Central Bank, the national central banks of other European Economic Area (EEA) States, government departments and local authorities.

Regulated businesses

If you are currently regulated by the Financial Conduct Authority (FCA) to provide payment services, please click on the option which describes your business:

• Bank or building society[7]
• Authorised payment institution (authorised PI) [8]
• Authorised electronic money institution (authorised EMI) [9]
• Small payment institution (small PI) [10]
• Small electronic money institution (small EMI)[11]

If you are unsure whether your business would be classed as an authorised PI, authorised EMI, small PI or small EMI, please search for your business on the Financial Services Register[12] and look for your ‘status’. This status will tell you the classification of your business. If you think you might instead be classed as a bank or building society but are unsure please refer to the Bank of England list of banks and building societies[13] – note that this list is intended to be used solely as a guide.

Excluded activities

Please look at the Perimeter Guidance manual (PERG) and our Approach Document[2] to find out whether the exclusion continues to apply to you. PERG 3[14] and PERG 15[15] are amended by the Payment Services Instrument 2017[16].

If some or all of your activities currently fall within an exclusion set out in Part 2 of Schedule 1 to the PSRs 2017[1], please click on one of the following options:

• Limited network exclusion (LNE)
• Electronic communications exclusion (ECE)
• Commercial agent exclusion (CAE)
• Other exclusion

Please note that businesses relying on an exclusion in respect of certain activities may nevertheless be required to be regulated by us (or notify us) in respect of other payment services carried out by them which do not fall under that exclusion.

Unregulated businesses that intend to offer regulated payment services

If you are currently not regulated by the FCA under the PSRs 2017 (link is external)[5] or the Electronic Money Regulations 2011 (link is external)[17] (EMRs 2011) and not otherwise a payment service provider (for example a credit institution or EEA payment institution) and you intend to provide payment services, please click on one of the following options which describe the payment service(s) you intend to carry out:

• Account information service (AIS) only[18]
• Account information service (AIS) and payment initiation service (PIS)[19]
• AIS and/or PIS combined with other payment or e-money services
• Other payment services not including AIS and PIS[20]

If you are unsure whether you may be providing payment services, you can find guidance in our Handbook in PERG 3A and PERG 15.

This navigator is not a substitute for reading the PSRs 2017[19] and our accompanying guidance. If there is any inconsistency between this navigator and the PSRs 2017[25], the FCA Handbook[18] or the Approach Document[15], those documents take precedence.
